Preliminary Clause
This manuscript, henceforward designated as the Directive on Merchandise Return and Exchange Legalities (the “Directive”), delineates the immutable legal statutes and codicils governing the contractual engagements concerning the return and exchange of merchandise (subsequently referred to as “Merchandise”) procured by the consumer (hereinafter denominated the “Acquirer”) from the electronic commercial domain known as Tokyo-Cosplay.com (hereinafter denominated the “Domain”). This Directive is construed in strict adherence to prevailing jurisprudential norms and shall be binding in equal measure upon the Acquirer and the Domain.
Article I: Lexicon of Terms
Within the ambit of this Directive, the terms enunciated below shall bear the respective significations imputed to them:
- “Merchandise”: Any goods rendered available for procurement on the Domain.
- “Acquirer”: An entity or individual that enacts a transaction on the Domain, thereby entering into a contractual nexus under the stipulations of this Directive.
- “Return Merchandise Authorization (RMA)”: An official sanction conferred by the Domain upon the Acquirer for the return or exchange of Merchandise in consonance with the terms delineated herein.
Article II: General Stipulations
Section 2.01: Sphere of Applicability
This Directive universally applies to all transactions consummated on the Domain, mandating the conditions under which Merchandise may be subject to return or exchange.
Section 2.02: Prerequisites for Return or Exchange
The privilege of return or exchange is contingent upon the Merchandise being in its pristine, unmarred, and non-utilized condition, encapsulated within its initial packaging, with all protective seals unbreached. The Acquirer is enjoined to furnish incontrovertible substantiation of purchase in advocacy of the return or exchange petition.
Article III: Procedural Ordinance
Section 3.01: Commencement of Return or Exchange Process
The Acquirer shall instigate the return or exchange process by lodging a formal requisition with the Domain’s designated concierge for consumer service, incorporating all apposite details germane to the transaction and the impetus for the return or exchange.
Section 3.02: Dispensation of RMA
Subsequent to a preliminary evaluation that meets the Domain’s satisfaction, an RMA will be dispensed to the Acquirer, which shall serve as a requisite condition precedent for the facilitation of the return or exchange.
Section 3.03: Conveyance of Returned Merchandise
The Acquirer is mandated to dispatch the Merchandise to the stipulated return locus provided by the Domain, at the Acquirer’s sole expenditure. It is strongly advised that a conveyance method furnishing tracking and indemnification is employed, as the Domain disclaims liability for Merchandise forfeited or compromised in transit.
Article IV: Adjudication and Determination
Section 4.01: Scrutiny and Appraisal
Upon its reception, the returned Merchandise will be subjected to an inspection by the Domain’s conclave of quality assurance to verify conformity with the return conditions as stipulated herein.
Section 4.02: Reimbursement or Exchange
- Reimbursement: Should the return be ratified, a reimbursement will be tendered to the Acquirer via the original modality of payment, exclusive of any conveyance costs, within a demarcated timeframe not to exceed thirty (30) business days.
- Exchange: Contingent upon the Acquirer’s preference for an exchange and subject to the availability of a commensurate Merchandise, the exchange will be processed and expedited to the Acquirer.
Article V: Ancillary Codicils
Section 5.01: Returns from Beyond Domestic Confines
For returns emanating from jurisdictions outside the operational purview of the Domain’s headquarters, the Acquirer shall bear all attendant costs, inclusive of, but not limited to, shipping, customs, and import duties.
Section 5.02: Codicil Amendments
This Directive is amenable to amendment or modification by the Domain at any juncture, sans prior notification to the Acquirer. The Acquirer is subjugated by the iteration of the Directive in force at the transaction’s inception.
Article VI: Resolution of Disputes
Disputes emergent under this Directive shall be adjudicated through binding arbitration pursuant to the arbitration rules of the American Arbitration Association, such arbitration to be situated in the jurisdiction where the Domain’s operational headquarters resides.
Article VII: Epilogic Declaration
Through the enactment of this Directive, the Domain solemnly avows its commitment to upholding a clear, equitable, and legally binding framework for the return and exchange of Merchandise, thereby safeguarding and enforcing the reciprocal rights and obligations of both the Acquirer and the Domain.
It is explicitly codified herein that the Acquirer is allotted a temporal window of thirty (30) days from the date of receipt of the Merchandise to initiate the return process, as stipulated under the procedural ordinance of Article III, Section 3.01.
